Are Employers Required to Accommodate the Religious Beliefs and Practices of Employees?

In New York and Florida, federal, state, and local laws require employers to accommodate an employee's “sincerely held” religious beliefs or practices unless the accommodation would impose an “undue hardship” on the business. An “undue hardship” is generally more than a minimal burden on operation of the business, and specific to an employee’s unique circumstances. A religious practice may be honestly held by an employee even if newly embraced, not regularly observed, or different from the commonly followed creeds of the employee's religion.

What Are Examples of Religious Accommodations Requested in the Workplace?

Religious accommodations in the workplace related to religious observances or practices include, for example, attending worship services, praying, wearing religious garb or symbols, displaying religious objects, adhering to certain dietary rules, refraining from certain work on holy days/times, proselytizing or other forms of religious expression, or refraining from certain activities.    

While whether a specific accommodation is required under the law depends on an employee’s specific belief and job duties. The following are examples:

  • An employer failing to make reasonable accommodations for religious beliefs, such as banning religious attire or symbols, refusing to allow time off, alternating work schedules, etc.
  • An employee needs accommodation of a religious belief that working on his Sabbath is prohibited.
  • A Catholic employee needs a schedule change so that he can attend church services on Good Friday
  • An atheist needs to be excused from the religious invocation offered at the beginning of staff meetings
  • Newly converting to Rastafarian, an employee now has the sincerely held religious beliefs of not cutting one’s hair despite the company’s policy requiring certain hair styles
  • An employee’s faith requires him to war a head covering
  • A Jehovah's Witness seeks to change job tasks at a factory so that he will not have to work on producing war weapons
  • A Muslim employee needs a short break and a small space to observe daily prayer

Legal Protections Against Religious Discrimination

In both Florida and New York, various laws protect employees from religious discrimination, and require the employees needing certain religious accommodations enjoy that right, including:

  • Title VII of the Civil Rights Act of 1964: Federal law that prohibits employment discrimination based on religion, requiring employers to accommodate religious practices. If an employee engages in such protected activity or complains of religious discrimination, any resulting retaliation is unlawful.
  • New York State Human Rights Law: State law that prohibits religious discrimination mandates reasonable accommodations for religious practices and prohibits retaliation.
  • New York City Human Rights Law: The city of New York further has additional laws that prohibits religious discrimination, mandates reasonable accommodations for religious practices, and prohibits retaliation.
  • Florida Civil Rights Act: Florida state law that provides protections against discrimination based on religion in the workplace.

What Are Examples of Religious Discrimination at Work?

  • Lack of promotion because of religion.
  • Unequal pay due to religious beliefs or practices.
